Miniature Painting
A miniature painting received as a gift from a non-relative
where FMV exceeds ₹50,000 triggers
Section 56(2)(x) taxability.
The Rule 11UA(1)(a) FMV certificate from a
Section 34AB Category VIII Registered Valuer
is the required document.
Valuation principle
School-specific FMV
A Rajput Bhagavata Purana folio and a Mughal imperial
portrait of the same physical size can command completely
different values because attribution and market hierarchy
materially affect FMV.

Section 55(2)(b)
Pre-2001
Miniature Collections
For miniature paintings acquired before 1 April 2001,
Section 55(2)(b) permits substitution of the
FMV as on 1 April 2001 as the capital
gain cost basis.
The retrospective valuation requires historical market
evidence for the specific school, period and
quality level, rather than relying on a current
market price.

Section 80G
Donation of
Miniature Paintings
Donation of Indian miniature paintings to the
National Gallery of Modern Art (NGMA),
Kiran Nadar Museum of Art (KNMA),
state museums and other Section 80G institutions requires
a contemporaneous Rule 11UA(1)(a) FMV certificate.

Indian miniature paintings may be encountered in Income Tax
search proceedings as collected artworks or investment
